1. Acceptance of Terms
By accessing or using PocketLeave ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms constitute a legally binding agreement between you and PocketLeave. We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.
2. Description of Service
PocketLeave is a free web-based tool that helps users optimize their annual leave by identifying opportunities to combine leave days with public holidays and weekends. The Service:
- Provides leave optimization suggestions based on public holiday data
- Allows users to plan and track leave allocations
- Offers calendar visualization of planned leave
- Enables optional account creation to save leave plans
- Publishes a blog (/blog) with leave planning articles and country-specific guides
- Provides country-specific annual leave guides (/guides) covering public holidays and leave entitlement information
3. User Eligibility
You must be at least 13 years old to use this Service. By using the Service, you represent and warrant that:
- You are at least 13 years of age
- You have the legal capacity to enter into these Terms
- You will provide accurate and truthful information
- You will comply with all applicable laws and regulations
4. User Accounts
Account creation is optional but required to save leave plans. If you create an account:
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized access or security breaches
- You may not share your account with others
- You may not create multiple accounts to circumvent Service limitations
5. Acceptable Use
You agree to use the Service only for lawful purposes. You must not:
- Use the Service in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service or servers
- Use automated systems (bots, scrapers) without express written permission
- Reverse engineer, decompile, or disassemble any part of the Service
- Transmit malware, viruses, or harmful code
- Impersonate any person or entity
- Use the Service for commercial purposes without authorization
6. Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, code, and software, are owned by PocketLeave and are protected by international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. This license does not include the right to reproduce, distribute, modify, or create derivative works.
7. Third-Party Services and Data
The Service relies on third-party data sources, including:
- Nager.Date API: Public holiday data for the majority of supported countries
- date-holidays npm package: Locally computed holiday data for Israel and Saudi Arabia
- Hardcoded static dataset: Holiday data for India, maintained within the application
- Supabase: Authentication and data storage services
- Notion: Blog content delivery for the /blog section of the Service
We are not responsible for the accuracy, availability, or reliability of third-party services. Any issues with third-party data should be directed to the respective service providers.
8. Disclaimer of Warranties
IMPORTANT DISCLAIMER
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We specifically disclaim any warranties regarding:
- Accuracy: Holiday data accuracy, calculation precision, or optimization results
- Availability: Uninterrupted or error-free service operation
- Employment Outcomes: Employer approval of leave requests or compliance with workplace policies
- Legal Compliance: Compliance with employment laws in your jurisdiction
- Data Security: Absolute protection against unauthorized access or data breaches
9. Not Employment or Legal Advice
CRITICAL NOTICE
PocketLeave DOES NOT provide employment advice, legal counsel, or professional guidance. The Service is a planning tool only and should not be relied upon as a substitute for:
- Your employer's official leave policies and procedures
- Employment contracts or collective bargaining agreements
- Legal advice from qualified employment attorneys
- Human resources department guidance
- Official government employment regulations
You are solely responsible for verifying leave entitlements, employer approval processes, and applicable workplace policies before making leave decisions.
This includes independently confirming all public holiday dates with your country's official government source before submitting leave requests. See Section 12 for full details on holiday data accuracy and your obligation to verify against official government datasets.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POCKETLEAVE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of employment or employment opportunities
- Denied or rejected leave requests
- Financial losses or lost wages
- Emotional distress or reputational damage
- Data loss or corruption
- Reliance on inaccurate holiday data or calculations
In no event shall our total liability exceed the amount you paid to use the Service (currently $0, as the Service is free).
11. Indemnification
You agree to indemnify, defend, and hold harmless PocketLeave and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any employment disputes arising from leave planning decisions.
12. Data Accuracy and Official Government Sources
YOU MUST VERIFY HOLIDAY DATES WITH OFFICIAL GOVERNMENT SOURCES
Public holiday data provided by PocketLeave is for planning purposes only. It may be outdated, incomplete, or may not reflect last-minute government declarations, gazetted amendments, emergency proclamations, or jurisdiction-specific variations. Before submitting any leave request to your employer or making travel arrangements, you must verify all holiday dates against your country's official government website, ministry of labour, or published government gazette. PocketLeave accepts no liability for any losses, denied leave, or other consequences arising from reliance on unverified holiday data.
Holiday data is sourced from the following, none of which guarantee completeness or real-time accuracy:
- Nager.Date API: Third-party API used for the majority of supported countries
- Hardcoded static dataset: Used for India — a manually maintained list built into the application, not a live feed
- date-holidays npm package: Used for Israel and Saudi Arabia — locally computed from calendar rules, not a live government feed. Dates that depend on the lunar calendar (such as Eid and certain Jewish holidays) may shift by 1–2 days based on official moon-sighting announcements and should be independently verified
We do not guarantee:
- The accuracy, completeness, or timeliness of any holiday data
- Updates for newly declared, amended, or cancelled holidays
- Region-specific or local holiday variations
- Employer-specific or industry-specific holiday observances
Official government holiday sources can typically be found on your national government's official website, the relevant ministry of labour or employment portal, or published government gazettes.
13. Algorithmic Calculations and AI Disclaimer
PocketLeave currently uses algorithmic calculations and optimization logic to provide leave suggestions. The Service does not currently employ artificial intelligence (AI) or machine learning technologies to generate recommendations.
However, we reserve the right to incorporate AI-powered features in the future, such as:
- Intelligent leave planning assistants or chatbots
- Personalized optimization recommendations based on usage patterns
- Natural language processing for user queries
- Predictive analytics for leave trends
If AI features are introduced, you acknowledge and agree that:
- No Guarantee of Accuracy: AI-generated content may contain errors, inaccuracies, or outdated information
- Not Professional Advice: AI outputs do not constitute employment, legal, or professional advice
- Verification Required: All AI-generated suggestions must be independently verified
- Human Oversight: You remain solely responsible for all leave planning decisions
- Continuous Improvement: AI features may improve over time but are provided as-is without warranties
We will notify users if significant AI features are added to the Service. By continuing to use the Service after such changes, you agree to these AI-related terms.
14. Service Modifications and Termination
We reserve the right to:
- Modify, suspend, or discontinue the Service at any time without notice
- Change features, functionality, or supported countries
- Terminate or suspend user accounts for Terms violations
- Remove or modify saved leave plans
We are not liable for any losses resulting from Service modifications or termination.
15. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PocketLeave operates, without regard to conflict of law principles. Any disputes arising from these Terms or use of the Service shall be resolved exclusively in the courts of that jurisdiction.
16. Dispute Resolution
In the event of any dispute, you agree to first attempt informal resolution by contacting us. If informal resolution fails, disputes may be subject to binding arbitration in accordance with applicable arbitration rules, unless prohibited by law.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
18. Changes to Terms
We may update these Terms periodically. The "Last Updated" date at the top indicates when changes were last made. Material changes will be communicated through the Service or via email to registered users. Your continued use of the Service after changes constitutes acceptance.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and PocketLeave regarding the Service and supersede all prior agreements and understandings.
